1. Description of Service
a.) Users
The search services provided by the campuspitch.com are free for users and entities that can form legally binding contracts under applicable law. The acceptance of this agreement acknowledges that campuspitch.com will provide a listing of random advertising mediums based on the search criteria entered by the user. Users can select up companies to request service quotes. All false or fraudulent service requests are strictly prohibited. Users agree that all information provided is true and accurate.
Personal information provided to campuspitch.com will not be sold or redistributed. Personal information provided from users to campuspitch.com will be used for the purpose of user quote requests. Using the services of campuspitch.com acknowledges that the user accepts that their personal information will be provided to the selected members chosen by the user for quote requests.
b.) College Newspapers
Newspaper Members must meet the following criteria:
1. Must carry the required licensing and permits as per Federal, state and local laws
2. Must be associated directly with the educational institution they represent
3. Members must accurately complete and submit the membership application
4. Members must supply campuspitch.com with a credit card authorization through PayPal.com for the use of monthly billing for leads sent to the member
5. Members are required to check and respond to "consumer" leads within 48 hours in a professional manner
Member information is provided to users by campuspitch.com and will be used for the purpose of user quote requests. campuspitch.com does not and cannot confirm that each user is who they claim to be.
2. Disclaimer of Warranties
The site is provided by campuspitch.com on an "as is" and on an "as available" basis. To the fullest extent permitted by applicable law, campuspitch.com makes no representations or warranties of any kind, express or implied, regarding the use or the results of this web site in terms of its correctness, accuracy, reliability, or otherwise. campuspitch.com shall have no liability for any interruptions in the use of this Website. campuspitch.com disclaims all warranties with regard to the information provided, including the implied warranties of merchantability and fitness for a particular purpose, and non-infringement.
campuspitch.com is not liable for the actions of its members, college newspapers, including but not limited to their employees. campuspitch.com is medium where users, individuals or entities seeking newspaper advertising, and college newspapers can interact, through campuspitch.com, to exchange information for the purposes of quote requests. As such, campuspitch.com is not involved in the transactions between the users and the newspaper. campuspitch.com is not responsible for the quality of service provided, safety of service, reliability of service, ability of newspapers to provide services or the users ability to purchase services. Disputes between the user and the newspaper will be handled by the college newspaper.
3. Limitation of Liability
CAMPUSPITCH.COM SHALL NOT BE LIABLE FOR ANY DAMAGES WHATSOEVER, AND IN PARTICULAR CAMPUSPITCH.COM SHALL NOT BE LIABLE FOR ANY SPEC IAL, INDIRECT, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, OR DAMAGES FOR LOST PROFITS, LOSS OF REVENUE, OR LOSS OF USE, ARISING OUT OF OR RELATED TO THE USE OF THIS WEB SITE OR THE INFO RMATION CONTAINED IN IT, WHETHER SUCH DAMAGES ARISE IN CON TRAC T, NEGLIGENCE, TORT, UNDER STATUTE, IN EQUITY, AT LAW, OR OTHERWISE, EVEN IF CAMPUSPITCH.COM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 4. Indemnification
Members and users agree to indemnify and hold campuspitch.com, its parents, subsidiaries, affiliates, officers and employees, harmless from any claim or demand, including reasonable attorneys' fees and costs, made by any third party due to or arising out of Member's or user's use of the Service, the violation of this Agreement, or infringement by Member or user, or other user of the Service using Member's or user's computer, of any intellectual property or any other right of any person or entity.
5. Modifications and Interruption to Service
campuspitch.com reserves the right to modify or discontinue the Service with or without notice to the Member or user. campuspitch.com shall not be liable to Member or any third party should campuspitch.com exercise its right to modify or discontinue the Service. Member acknowledges and accepts that campuspitch.com does not guarantee continuous, uninterrupted or secure access to our website and operation of our website may be interfered with or adversely affected by numerous factors or circumstances outside of our control.
6. Third-Party Sites
Our website may include links to other sites on the Internet that are owned and operated by online merchants and other third parties. You acknowledge that we are not responsible for the availability of, or the content located on or through, any third-party site. campuspitch.com retains the right to examine any and every quote request submission through submitted campuspitch.com. campuspitch.com retains the right to sensor, edit, remove or prohibit the transmission or receipt of any information deemed inappropriate.
